Once a certificate has been revoked by the Discipline Committee of Fitness to Practise Committee, can it be reinstated?
Yes, a member can have their certificate of qualification and registration reinstated unless the certificate was revoked because the member engaged in certain types of sexual acts involving students. Members must apply to have their certificate reinstated, and after they have completed their application in accordance with Rule 17 and section 33 of the Ontario College of Teachers Act, a panel of the Discipline Committee or of the Fitness to Practise Committee will hear their case. In a reinstatement hearing, the member has the burden of proving that their certificate should be reinstated, and the College may argue against reinstatement. Section 33 of the Ontario College of Teachers Act sets out when a revoked certificate may be reinstated and how long a member must wait before they can apply for reinstatement.
