What happens when a witness is called to testify?
The witness will be invited to join the hearing when the panel is ready to hear their testimony. A Tribunals Clerk will swear in the witness by way of an oath or an affirmation. The Chair will instruct the witness to state their name, to confirm that they are alone, and to confirm that they have no notes or documents in front of them. The parties will take turns questioning the witness. The panel can also ask the witness questions. The witness will be dismissed when there are no more questions. While the case is ongoing, the witness is not allowed to discuss their evidence, what they said or what they heard during the hearing.
