What deadlines should members be aware of?
All hearings-related deadlines are set out in the Rules of Procedure. Deadlines include:
- Motions (Rule 5): If a member wants to bring a motion, they must deliver the Form 5A: Notice of Motion and motion materials to the parties and the Tribunals’ Office, by the Tuesday that is at least 10 days before the hearing of the motion. The other motion participants (including if a member is responding to the College’s motion) may deliver additional evidence by the Tuesday that is at least three days prior to the hearing.
- Pre-hearing Conferences Memorandum (Rule 6.02 and Form 6A): The College must deliver their memorandum at least 20 days before the date of the pre-hearing conference. In response, a member must deliver their memorandum and any other documents at least 10 days before the date of the pre-hearing conference. If a party disagrees with a direction given at the pre-hearing conference, they must submit their written notice of the proposed change to the direction within three days after the pre-hearing conference.
- Delivering Materials for Electronic Hearings (Rule 8.02): A member must deliver every document that they intend to rely upon at the hearing to the College and the Tribunals’ Office, at least five business days before the hearing and in accordance with the requirements set out in Rule 2.01.
- Witnesses (Rule 13.11 and Practice Direction for Electronic Proceedings): A member must confirm with the Tribunals’ Office at least five business days prior to the scheduled proceeding, which witnesses they intend to call, their contact information, in what order and what time they intend to call them, and how they intend to put documents or materials before their witness.
