What outcome can be ordered if a member is found guilty of professional misconduct, or to be incompetent or incapacitated?
The Discipline Committee and Fitness to Practise Committee can issue one or more of the following orders after making a finding of professional misconduct, incompetence or incapacity:
- Revocation of the member’s certificate, which means they cannot work in a position where a teaching certificate is required.
- Suspension of the member’s certificate, which means the member cannot work in a position where a certificate is required for a period of time, up to 24 months.
- Impose terms, conditions or limitations on the member’s certificate, such as additional training, coursework or teaching restrictions.
The Discipline Committee can also order one or more of the following:
- Reprimand of a member, either in writing or orally.
- Require the member to pay a fine up to $5,000 to the Minister of Finance.
- Require the member to pay costs to the College.
- Require the member to reimburse the College for funding provided in relation to therapy and counseling sought by the victim or students, parents, guardians or siblings (if the member has been found guilty of sexual abuse, a prescribed sexual act or a prohibited act of child pornography).
